1. Using Our Products

You must use our apps and websites in compliance with applicable laws and only for their intended purpose. You're responsible for the activity that happens under your account.

2. Eligibility

You must be at least 13 years old, and capable of forming a binding contract, to use our products. If you're using a product on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.

3. Accounts

Some products require an account. You agree to provide accurate information and to keep your login credentials secure. You're responsible for anything that happens through your account. You can request that we delete your account and associated data at any time by contacting info@jackhammerlabs.com, or by using the account deletion option within the app if available.

4. Acceptable Use

You agree not to:

• Use our products for anything illegal or harmful
• Attempt to reverse engineer, hack, or disrupt our services
• Interfere with other users' access to our products
• Misrepresent your identity or impersonate others

5. Payments & Subscriptions

Some products may offer paid features or subscriptions. Where applicable, pricing, billing frequency, and cancellation terms will be presented at the time of purchase. Subscriptions purchased through an app store (e.g. Apple App Store, Google Play) are billed and managed by that platform, and cancellations must be handled through your account with that platform. Except where required by law or stated otherwise at the time of purchase, payments are non-refundable.

6. Intellectual Property

All our apps, websites, branding, and content are owned by Jackhammer Labs LLC unless otherwise stated. You may not copy, modify, or redistribute our products without permission.

7. Your Content

If you submit content through one of our products (e.g. messages, feedback, or uploads), you retain ownership of it, but you grant us a license to use it as necessary to operate the product.

8. Data & Privacy

Our collection and use of your data is described in our Privacy Policy. We don't sell your data.

9. Service Availability

We aim to keep our products running reliably, but we don't guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue a product at any time.

10. Disclaimer of Warranties

Our products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that our products will meet your requirements or be free of bugs or interruptions.

11. Limitation of Liability

To the fullest extent permitted by law, Jackhammer Labs LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products. Our total liability for any claim arising out of or relating to these Terms or our products will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred US dollars ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Jackhammer Labs LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our products, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to a product if you violate these Terms. You may stop using our products at any time.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or our products will be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there, except where applicable law requires otherwise (for example, certain consumer protections in your home jurisdiction).

15. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Jackhammer Labs LLC regarding our products.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of our products after changes take effect means you accept the updated Terms.
